BDK Advokati hosted a workshop on the Serbian Staff Leasing Act (“Act“) that came into force on 3 March 2020. Senior associate Nikola Cincović and associate Marija Gligorević led the workshop that was attended by the representatives of companies who were eager to hear about the specifics of the new legislation and discuss the challenges of its future implementation.
Nikola and Marija explained the difference between staff leasing and outsourcing and elaborated on the cases when staff leasing is prohibited. They further explained the challenges posed by the legislative quota on fixed-term staff leasing. The concept of “comparative employee” has stirred a lot of controversies.
Rights of leased employees and termination of leased employees were also discussed. The work shop concluded with the elaboration on the topic of personal data protection in the context of staff leasing.
The presentation was followed by Q&А session that sparked fruitful discussion between the participants and our presenters.
