On 7 June 2013, the provisions of the Law on Planning and Construction (Zakon o planiranju i izgradnji, Official Gazette RS no. 72/2009, 81/2009, 64/2010, 24/2011, 121/2012 and 42/2013) on legalization of buildings (Articles 185 through 200) ceased to be in force as a result of the publication in the Official Gazette of the decision of the Serbian Constitutional Court declaring the respective provisions unconstitutional.
The decision was actually rendered six months ago, but the Constitutional Court withheld its publication in order to allow the legislator to amend the provisions found to be unconstitutional. However, this gentleman’s offer was not accepted by the Serbian Parliament, which failed to amend the law. Read more
