Workshop on termination of employment for breach of work duty and work discipline

Termination by employer for employee’s breach of work duty or work discipline is the most common cause of employment termination and the one that often gives rise to challenges. Our senior associate Marija Gligorević held last week a workshop for in-house counsels and HRs, addressing a number of practical aspects of the termination process that have to be kept in mind in order to minimize the risk of litigation, including:

  • regulating timely and comprehensively the catalogue of breaches the employer considers grave enough to warrant dismissal;
  • what to do if a particular behavior is not covered by the catalogue but is grave enough to warrant termination;
  • reacting timely to the behavior representing the breach;
  • how to make termination process and termination documentation resistant to challenges;
  • situations when suspension from work is warranted pending the process and the scope of permitted suspension.

Marija also explained when it may be reasonable to consider alternatives to dismissal.

All topics were illustrated with useful examples from the extensive practice of Serbian courts.

Participants contributed to the discussion by offering interesting examples from their own experiences.
