BDK Advokati contributes to Chambers Merger Control 2026 Global Practice Guide
BDK Advokati's partner Bisera Andrijašević and associate Marija Ksenija Popović authored the Montenegro chapter in the newly published Chambers Merger Control 2026 Global Practice Guide. This year's Guide features 40 jurisdictions, with Jean-François Bellis and Porter Elliott from Van Bael & Bellis acting as Contributing Editors.
The Law and Practice section of the Guide provides a comprehensive overview of Montenegro's merger control framework, covering key aspects such as applicable legislation, enforcement authorities, notification requirements, the authority's approach to foreign-to-foreign transactions, joint ventures, third-party rights, confidentiality, cross-border cooperation, appeals, judicial review, and the authority's current competition concerns.
In the Trends and Developments article, we examined the most significant development of the past year: the adoption of an entirely new Competition Act, which entered into force on 2 April 2026, followed by new implementing legislation formally incorporating a wide range of EU competition soft law into the domestic framework. We analysed the key merger control changes and their practical implications for businesses, including the abolition of the 15-day filing deadline, the more structured Phase I timeline, greater flexibility in accepting commitments, and the recalibrated sanctioning regime. We also addressed the reforms left unaddressed, such as the persistently low notification thresholds, the absence of a local nexus test, and the decision to retain fining powers with the courts rather than the Agency.
