Marko Popović, associate in BDK Advokati’s IP and data protection practice, gave a lecture “Street photography through the lens of copyright and right to privacy”, as part of the international festival Belgrade Photo Month, on 19 April 2017. Marko spoke about legal challenges arising from snapping photos in public places. The audience, mainly comprised of photographers, could learn how they benefit from the freedom of panorama, and why is it allowed to photograph the Eiffel Tower during the day but not at night. Judging from the number of questions, the audience was especially interested in privacy and data protection issues in the context of street photography. The discussion revolved around whether there is a legal requirement to obtain consent from the photographed person. Marko analyzed recent case law showing the different ways in which European and US courts balance the right to privacy and the freedom of expression.
